The effect of uniform lighting on face identity processing is little understood, despite its potential influence on our ability to recognize faces. Here, we investigated how changes in uniform lighting level affected face identification performance during face memory tests. Observers were tasked with learning a series of faces, followed by a memory test where observers judged whether the faces presented were studied before or novel. Face stimuli were presented under uniform bright or dim illuminations, and lighting across the face learning (...) and the memory test sessions could be the same or different. This led to four experimental conditions: Bright/Dim ; Bright/Bright; Dim/Bright; and Dim/Dim. Our results revealed that incongruent lighting levels across sessions significantly reduced sensitivity to faces and introduced conservative biases compared to congruent lighting levels. No significant differences in performance were detected between the congruent lighting conditions and between the incongruent lighting conditions. Thus, incongruent lighting deteriorated performance in face identification. These findings implied that the level of uniform lighting should be considered in an illumination-specific face representation and potential applications such as eyewitness testimony. (shrink)

In recent months, pharmaceutical manufacturers have brought legal challenges to a provision of the 2022 Inflation Reduction Act (IRA) empowering the federal government to negotiate the prices Medicare pays for certain prescription medications. One key argument made in these filings is that price negotiation is a “taking” of property and violates the Takings Clause of the US Constitution. Through original case law and health policy analysis, we show that government price negotiation and even price regulation of goods and services, including (...) patented goods, are constitutional under the Takings Clause. Finding that the IRA violates the Takings Clause would radically upend settled constitutional law and jeopardize the US’s most important state and federal health care programs. (shrink)

Classifying human beings according to race and ethnicity may seem straightforward to some but it, in fact, belies a difficult process. No standard procedure exists for categorizing according to race and ethnicity, calling into question the variables’ use in research. This article explores the use of race and ethnicity variables in the nursing research literature. Content analysis was conducted of a sample of 337 original research studies published in Nursing Research from the years 1952, 1955, and then every 5 years (...) through to 2000. Of the 337 research articles reviewed, 167 mentioned race, ethnicity, or their 81 code words or phrases. Out of the 167 articles, 153 used race or ethnicity to describe the study sample, and 45 of the 167 articles included race or ethnicity as an element of data analysis. Throughout the sample, there was substantial inconsistency related to race and ethnicity categorization, meanings of the terms, and use of these variables. Specificity related to conceptual assumptions, definitions, and context was missing and, as a result, data interpretation and understanding are suspect. The integrity of nursing knowledge requires that nurse researchers recognize and address the difficulties inherent in using race and ethnicity in health research. (shrink)

BackgroundResearch and academic institutions use various delivery channels to deliver Research Integrity education in their communities. Yet there is no consensus on the best delivery method and the effectiveness of these channels in inculcating a positive RI culture varies across institutions. Hence, this study aimed to understand the preferences of the research community in Nanyang Technological University, Singapore.MethodsAn online survey was conducted on NTU research community to understand their experience with, and preference for each RI education mode offered in NTU. The RI education modes surveyed in the general ranking question are Data Management Plan workshops, Epigeum e-Learning, Compass e-newsletter, and NTU policy on Research Integrity and Responsible Conduct of Research. There were 242 responses, comprising 50% research students, 32.2% research staff and 17.8% faculty members. Non-parametric statistical techniques were used to analyse preferences across different RI education modes and within sub-groups.ResultsMore than 92% of respondents subscribed to the importance of RI education, but with different preferences for education modes. With respect to RI education in NTU, Compass e-newsletters were ranked the lowest. Most felt that they were too wordy and unengaging, making it difficult to absorb information. Similarly, Epigeum e-Learning and ‘policy’ were found to be too lengthy in presentation. The compulsory NTU RI education modes enjoyed higher participation rates of 70–80% compared with 32–37% for the self-regulated modes. This suggests that regulatory mechanisms are still necessary to promote participation in RI education, and thus, core RI education content should be made compulsory in research/academic institutions. Although Epigeum is a compulsory course, some may not have participated in the programme due to technical issues or they might have forgotten to participate in the programme within the permissible timeframe. For all four RI education modes in NTU, the lack of awareness was among the top cited reasons for not participating.ConclusionsMost NTU researchers perceived RI education positively although they may have reservations for some approaches. Conversely, e-Learning is favored over all the other modes except for the mode of Policy. Findings from this study are useful for improving the design of RI education strategies to be more appealing to the research community by enhancing user experience in terms of user-friendliness, relevance to specialisation, providing concise information and better presentation of materials For institutions with similar modes of RI education as NTU, these results may be relevant in improving participation rates and presentation of RI education modes, such as the use of infographics and more concise information. Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. En el presente artículo proponemos una reflexión sobre el concepto y los usos de la interculturalidad en América Latina. Pensamos que debemos seguir apostando por la posibilidad de construcciones discursivas alternativas, críticas y estéticas observables y vivenciales en el derecho a la educación, respetando y aprendiendo de las diferencias. Partimos de una epistemología «otra» que pone en discusión el conocimiento «universal», en la medida que buscamos posicionar conocimientos «otros». Asimismo, cuestionamos lo establecido por la institucionalidad de los discursos oficiales y (...) apelamos a iniciativas emergentes enfocadas en la construcción y consolidación de nuevas subjetividades. En el marco de una relacionalidad vivencial simbólica buscamos dar cuenta de la unidad en la diversidad, la dualidad complementaria y la reciprocidad, lo que implica que sigamos apuntándola a un intercambio dinámico y fluido de saberes, y a la construcción colectiva del conocimiento como responsabilidad social compartida, no sólo en el discurso, sino en actos coherentes de una diversidad de actores sociales que aprecian sus diferencias, pero no son ajenos a la situación de los otros y a la inequidad social. In this paper we intend to reflect on the concept and practices of multiculturalism in Latin America. We think we should keep committing ourselves to the possible creation of alternative, critical, aesthetic, experiential and perceptible discourses on the right to be educated, respecting and learning from differences. We start from an «other» epistemology that raises questions about the «universal» knowledge as we seek to locate «other» knowledges. Furthermore, we question what is established by the institutionalization of official speeches, and we appeal to emerging initiatives focused on the construction and consolidation of new subjectivities. As part of a symbolic experiential relatedness we aim to account for unity in diversity, complementary duality and reciprocity, which means that we continue pointing out to a dynamic and fluid knowledge exchange, and to the collective construction of knowledge as a shared social responsibility not only in speech, but also in consistent acts of a variety of social actors who appreciate their differences, not unaware of the situation of other people and of social inequality. A partir de estos y otros interrogantes, el presente artículo tiene por objetivo problematizar la producción y reproducción de sentidos generizados en la industria de videojuegos argentina, tanto en la elaboración de los contenidos como en la fase de creación y el momento del consumo. Partiendo de un enfoque cualitativo, centrado en una revisión bibliográfica sistemática, planteamos que las instancias de creación, diseño y consumo (...) de los videojuegos se encuentran atravesadas por un fuerte imperativo de la masculinidad que reproduce una mirada androcéntrica, lo que supone un lugar subordinado para las diversas feminidades. No obstante, tal barrera prohibitiva no es ineludible si tenemos en consideración la agencia de lxs sujetos en la construcción de estrategias e intersticios para poner en jaque la normatividad. Cet article présente une série d’épigrammes hellénistiques généralement peu étudiées et quelques témoignages littéraires et épigraphiques attestant le culte d’Aphrodite en tant que protectrice de la navigation. Les temples de la déesse occupaient souvent une position littorale, non parce qu’ils étaient des lieux où la « prostitution sacrée » était pratiquée, mais plutôt en raison de l’association d’Aphrodite avec la mer et de son rôle de patronne des marins. La protection qu’elle accordait était destinée à tous les navigateurs, y compris (...) la marine et les commerçants, et est attestée dans toute la Méditerranée, depuis la période archaïque jusqu’à la période hellénistique. De plus, les textes examinés révèlent un lien métaphorique entre les rôles d’Aphrodite comme protectrice de la navigation d’une part et comme déesse de la sexualité d’autre part. (shrink)

Analizamos aquí un conjunto de narrativas de docentes de escuela secundaria durante la pandemia de COVID-19 en la Argentina. Los resultados muestran la transformación de su práctica ante la virtualidad forzada y la pérdida de la materialidad de la escuela. La institución aparece así como el lugar de “lo común” y de fortalecimiento de los vínculos en un contexto de incertidumbre.

Durante los años menemistas, las políticas públicas de memoria estuvieron orientadas principalmente a “pasar la página”. Los mayores exponentes de esta postura fueron los indultos a los jerarcas de las Fuerzas Armadas de la última dictadura militar (1976-1983), decretados y publicados entre los años 1989 y 1991. Años después, otro suceso volvió a hacerla particularmente visible: el intento de demoler los edificios de la ESMA y colocar en su lugar un monumento a la “reconciliación nacional”. Esto despertó gran polémica con (...) los organismos de DDHH, con la oposición y dentro de la propia alianza gobernante y fue, además, el puntapié inicial para lo que hoy es el Sitio de la Memoria ex-ESMA. Sin embargo, hubo otras políticas culturales en este período que también son una muestra del afán de dejar atrás la memoria sobre los años de violencia política y represión, y que pasaron más desapercibidos. Este artículo propone un análisis del caso de los monumentos referidos al bombardeo a Plaza de Mayo del 16 de junio de 1955, atentado perpetrado por miembros de las Fuerzas Armadas en el que murieron más de 300 personas, colocados en la década de 1990. Tomando como caso análogo lo propuesto para el predio de la ESMA, se analizará el texto de los decretos –y en segundo plano el de los indultos en el año 1991– en relación al contenido de los memoriales. In the Cairo Genizah were manuscripts with Gregorian notation and Hebrew script. They also appeared documents that point to author of the scores at Giovanni-Obadiah, a twelfth century Christian monk, born in southern Italy, who converted to Judaism. Until now, the study of this personage has been realized almost exclusively from the Jewish point of view. Nevertheless, like Obadiah synthesizes the traditions Christian and Jewish in its notation when copying Hebrew melodies with Christian notation, also it does in his texts. (...) Obadiah transcribed a Latin appointment of Joel to Hebrew characters. This article pretends to oppose his conversion to Judaism with his ordination as a Christian monk through the prophecy of Joel, which implies an intense dialogue between the two traditions. (shrink)

This paper aims at foregrounding race and ethnicity discourse in Biblical Studies and beyond in order to undermine transhistorical and transcultural racism and ethnocentrism in religious discourse. It is my argument that matters of race and ethnicity should be approached as analytical categories in an interdisciplinary manner, albeit in a specific context, Hellenistic, Roman, Jewish, or Christian. In doing so, I first examine the works of Steve Fenton as well as Robert Miles and Malcolm Brown in order to look closely (...) at race and ethnicity discourse in the ancient Mediterranean world, especially from a sociological perspective. Then, I indicate how Jonathan Hall and Shaye Cohen examine Hellenic and Jewish identity, respectively, with a focus on ethnic identity in the Greco-Roman world. Finally, I consider how Judith Lieu and Denise Buell analyze early Christian identity as a racial or ethnic discourse in the Jewish, Hellenistic, and Roman matrix. Hence, I contend that identity in general and racial-ethnic identity in particular are by no means stable and static in essentialist terms, but rather they are fluid along the ostensible axis of fixed identity. ‘Substance’ (substantia, zelfstandigheid) is a key term of Spinoza’s philosophy. Like almost all of Spinoza’s philosophical vocabulary, Spinoza did not invent this term, which has a long history that can be traced back at least to Aristotle. Yet, Spinoza radicalized the traditional notion of substance and made a very powerful use of it by demonstrating – or at least attempting to demonstrate -- that there is only one, unique substance -- God (or Nature) -- and that all other things are (...) merely modes or states of God. Some of Spinoza’s readers understood these claims as committing him to the view that only God truly exists, and while this interpretation is not groundless, we will later see that this enticing and bold reading of Spinoza as an ‘acosmist’ comes at the expense of another audacious claim Spinoza advances, i.e., that God/Nature is absolutely and actually infinite. But before we reach this last conclusion, we have a long way to go. So, let me first provide an overview of our plan. In the first section of this paper we will examine Spinoza’s definitions of ‘substance’ and ‘God’ at the opening of his magnum opus, the Ethics. Following a preliminary clarification of these two terms and their relations to the other key terms defined at the beginning of the Ethics, we will briefly address the Aristotelian and Cartesian background of Spinoza’s discussion of substance. In the second section, we will study the properties of the fundamental binary relations pertaining to Spinoza’s substance: inherence, conception, and causation. The third section will be dedicated to a clarification of Spinoza’s claim that God, the unique substance, is absolutely infinite. This essential feature of Spinoza’s substance has been largely neglected in recent Anglo-American scholarship, a neglect which has brought about an unfortunate tendency to domesticate Spinoza’s metaphysics to more contemporary views. The fourth section will study the nature of Spinoza’s monism. It will discuss and criticize the interesting yet controversial views of the eminent Spinoza scholar, Martial Gueroult, about the plurality of substances in the beginning of the Ethics; address Spinoza’s claim in Letter 50 that, strictly speaking, it is improper to describe God as “one”; and, finally, evaluate Spinoza’s kind of monism against the distinction between existence and priority monism recently introduced into the contemporary philosophical literature. The fifth and final section will explain the nature, reality, and manner of existence of modes. We therefore have an ambitious plan; let’s get down to business. (shrink)

A new research area linked to ethics, virtues, and morality is servant leadership. Scholars are currently seeking publication outlets as critics debate whether this new leadership theory is significantly distinct, viable, and valuable for organizational success. The aim of this study was to identify empirical studies that explored servant leadership theory by engaging a sample population in order to assess and synthesize the mechanisms, outcomes, and impacts of servant leadership. Thus, we sought to provide an evidence-informed answer to how does (...) servant leadership work, and how can we apply it? We conducted a systematic literature review (SLR), a methodology adopted from the medical sciences to synthesize research in a systematic, transparent, and reproducible manner. A disciplined screening process resulted in a final sample population of 39 appropriate studies. The synthesis of these empirical studies revealed: (a) there is no consensus on the definition of servant leadership; (b) servant leadership theory is being investigated across a variety of contexts, cultures, and themes; (c) researchers are using multiple measures to explore servant leadership; and (d) servant leadership is a viable leadership theory that helps organizations and improves the well-being of followers. This study contributes to the development of servant leadership theory and practice. In addition, this study contributes to the methodology for conducting SLRs in the field of management, highlighting an effective method for mapping out thematically, and viewing holistically, new research topics. I have developed transcendental arguments to refute several versions of Nick Bostrom’s simulation hypothesis. I called some of these arguments the SIM-style argument. In this paper, I have four main aims. First, I employ the SIM-style argument to remedy a defect in Hilary Putnam’s Brain-in-vat argument. Second, I show that the most radical skepticism, which Tim Button called the nightmarish Cartesian skepticism, can be refuted by the SIM-style argument or by another transcendental argument I develop here. Third, I compare my (...) approach to radical skepticisms with Donald Davidson’s, as it is often regarded as an exemplar of transcendental arguments. Fourth, I explain how the prominent objections, mainly developed by Barry Stroud, to transcendental arguments can incur two undesirable results: psychologism and Kantian skepticism. (shrink)

Prior researchers have studied individual components of a theoretical decision-making model. This paper presents the results of a more complete study of the model components and presents limited support of theory. The study examines the relative importance of regulatory, organizational, and personal constructs on an individual''s ethical sensitivity. Auditors from the major international accounting firms, located in two southeastern cities, are surveyed. Structural equation modeling is used to allow for the simultaneous evaluation of the three constructs of interest. The results (...) indicate that the regulatory and organizational constructs are negatively correlated with the personal experience construct. The three constructs are not significant causal factors on ethical sensitivity. This result may be due to the manner in which ethical sensitivity is typically measured or may indicate that the complexity of the ethical decision-making process is not fully captured in the theoretical models. Thus, the models suggested in the prior literature and the results presented in prior studies of the individual components may need to be reconsidered. (shrink)

An important contribution of Alan Patten’s Equal Recognition is the conception of neutrality that grounds his defence of minority cultural rights. Built in to his conception of neutrality of treatment is a notion of ‘fairness’ whose effect is to provide an upfront, across the board limitation on the demands cultural minorities may legitimately make on the rest of society. There must be limits on the duty to accommodate, but it obscures more than it illuminates to build this into the content (...) of the right to equal recognition itself. We see more clearly what is at stake in these conflicts by articulating the value of self-determination independently and taking account of necessary limits to its satisfaction as part of a second-stage analysis of what duties may be claimed and against whom. Familiar principles of discrimination law exemplify this alternative model. This presents the interest in self-determination more robustly, while acknowledging that the claims of duty arising out of it are defeasible. The result is a more flexible and nuanced exploration of the complex moral issues involved when fundamental interests clash. (shrink)

Toplumsal/tarihsel gerçekliğin incelenmesi adeta toplumun kurumsallaşmış unsurlarından biri olan zamanın da incelenmesini gerekli kılar. Kültürelci yaklaşımlarda zaman konusu bilhassa tarihselcilik ve eleştirisi bağlamında ele alınmaktadır. Tarihselciliği eleştiren ve buna alternatif teşkil eden yaklaşımlar da zaman tasavvuru ve bunun seçilen yönteme etkisi bakımından tarihselciliğin bazı ön kabullerini paylaşmaktadır. Bu alternatifler modernist sosyal bilimlerin (...) zaman algısına yönelik esaslı bir sorgulamadan uzaktır. Postmodernist sosyal bilimlerdeki mekân vurgusu ise ötekini ortak bir insanlık zamanının dışında konumlandırmaya dönük modernist varsayımın izlerini taşımaktadır. Bu çalışma zaman tasavvurunun sosyal bilimsel yönteme yansımalarına ve kültürel taksonominin zamanla ilişkisine dair eleştirel/anlayıcı bir perspektif sunmak ve yöntembilim tartışmalarında eksik kalan bu boyuta katkı sağlamak amacındadır. The development of the CRISPR gene editing technique has been hyped as a technique that could fundamentally change scientific research and its clinical application. Unrecognized is the fact that it joins other technologies that have tried and failed under the same discourse of scientific hype. These technologies, like gene therapy and stem cell research, have moved quickly passed basic research into clinical application with dire consequences. Before hastily moving to clinical applications, it is necessary to consider basic research and determine (...) how CRISPR/Cas systems should be applied. In the case of single gene diseases, that application is expected to have positive impacts, but as we shift to more complex diseases, the impact could be unintentionally negative. In the context of common disabilities, the level of genetic complexity may render this technology useless but potentially toxic, aggravating a social discourse that devalues those with disabilities. This paper intends to define the issues related to disability that are associated with using the CRIPSR/Cas system in basic research. It also aims to provide a decision tree to help determine whether the technology should be utilized or if alternative approaches beyond scientific research could lead to a better use of limited funding resources.
